No so many years ago people argued that an online web server is an open invitation for anybody. Now if you have a link you can't use it because of TOS? Is this enforceable? How do you get the TOS? You download the link to it? Man, what if you used "automated means" to download the TOS does it count as a breach of rules - which you didn't know before the download? Are you punishable for this?
